Cruz scandal deserves lawsuit – unless it’s true

Ted Cruz should easily win a lawsuit against false story, unless there is truth to it.

Ted Cruz has argued before the Supreme Court of the United States. He should have no problem wining a lawsuit for defamation against the National Enquirer, unless the story has merit.

Last week Donald Trump threaten to spill the beans on Ted Cruz’s wife Heidi after a Super PAC ran nude photo of Trump’s wife.

 


This lead to an escalation of insults between Sen. Ted Cruz and Donald Trump. The situation peaked when the National Enquirer ran a story that Ted Cruz  had multiple alleged affairs. Cruz responded with this message:

I want to be crystal clear: these attacks are garbage. For Donald J. Trump to enlist his friends at the National…

Sen. Cruz is right, this attack is a horrible and offensive smear of a presidential candidate. Many have blamed Trump for planting this story as he is reportedly linked to David Pecker, the CEO of National Enquirer’s parent company. Trump has denied involvement in this personal attack against Cruz’s character.

The Washington Post writes: Cruz also took the leaders of the Enquirer to task, saying they were in league with the Trump campaign.

“The CEO of the National Enquirer is an individual named David Pecker,” said Cruz. “Well, David is good friends with Donald Trump. In fact, the National Enquirer has endorsed Donald Trump, has said he must be president … [and] years from now, when my daughters google this, they will read these lies, these attacks that Donald and his henchmen, that his buddies at the National Enquirer spread about him.”

Cruz, who addressed the National Enquirer story for seven minutes, closed by analyzing “how a rumor gets spread.”

“They get their henchmen to put it out on the Internet,” he said. “Then they get the National Enquirer to report – not based on facts, not based on witnesses, but based on their reporting – that it’s on the Internet after they put it on the Internet. And I would note, another site, Gawker, which just had a $100 million judgment against them, then reports that the National Enquirer is reporting on these rumors, all of which started with Donald Trump.”

Hulk Hogan recently won a lawsuit against Gawker for over $100 million dollars for publishing a personal scandalous video online.

This story is very hurtful to Ted Cruz who has campaigned for the hearts and souls of evangelical Americans. His father Rafael Cruz, is a christian preacher has sung his son’s praises to fire up christian conservatives. Ted Cruz has positioned himself as the righteous candidate in this brutal campaign.

Sen. Cruz was the Texas state Solicitor General who argued cases before the Supreme Court. His is highly regarded in the legal community with his Harvard education and professional experience.

The Texas senator knows full well that the definition of defamation is: the action of damaging the good reputation of someone; slander or libel. The National Enquirer story if false, may fit this action.

Gov. Mike Huckabee recently said this on Fox News: “If Ted Cruz wants to really fight this, I hope he sues the National Enquirer. I mean, look at it. After we saw what happened to Gawker with Hulk Hogan, I think he has a terrific opportunity to file the lawsuit. That’s the way to fight some of this stuff.”

There are currently no reports of a lawsuit against the National Enquirer by Ted Cruz. If the story is false, where is the defamation lawsuit? The lack of a suit brought by such a qualified attorney might create doubt to the claims that parts of the story may be untrue.

How can anyone trust Ted if he does not file a lawsuit?

The truth will set Ted Cruz free.
